The Court of Appeal in Lagos state hasheld the decision of the Federal High Court ordering the seizure of property belonging to Government Ekpemupolo, better known as Tompolo.

Justice I.N Buba of the Federal High Court, Lagos, had ordered the seizure of the property over Tompolo’s refusal to appear in court over a fraud case involving him.

The Economic and Financial Crimes Commission (EFCC) had filed an application before the judge, seeking to seize Tompolo’s property, pending his arrest or appearance before the court.

The court granted EFCC’s request which the ex-militant challenged at the appeal court.

Delivering the judgment on Thursday, October 26, the appellate court held that Tompolo must respond to the summons before it can consider the reversal of the seizure order.

It said the ex-militant should appear before the federal high court to apply for the order to be discharged instead of filing an appeal.
